General Terms and Conditions
1. Scope
The following Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are neither commercial nor self-employed professional. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Christoph Seiler, trading as „Pew Toys“.
By listing products in the online shop, we submit a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and may correct your entries at any time before submitting your binding order by using the correction functions provided and explained during the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by e-mail.
3. Contract Language, Storage of Contract Text
The language(s) available for the conclusion of the contract: German, English
We store the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery Terms
We deliver the products to the delivery address provided during the ordering process.
We only deliver by shipping. Personal pickup of the goods is unfortunately not possible.
5. Payment
The following payment methods are generally available in our shop.
Advance Payment: If you choose the advance payment option, we will provide our bank details in a separate e-mail and deliver the goods after receipt of payment.
Credit Card: You enter your credit card details during the ordering process.
Your card will be charged immediately after submitting the order.
PayPal, PayPal Express: To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg („PayPal“), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction.
The payment transaction will be processed by PayPal immediately after submitting the order. Further instructions are provided during the ordering process.
PayPal may offer registered PayPal customers additional payment methods in their customer account at its own discretion. We have no influence on the offering of these methods; any further individually offered payment methods are subject to your legal relationship with PayPal. 6. Warranty and Guarantees
6.1 Liability for Defects
The statutory liability for defects applies. For used goods, the statutory warranty period may be limited to one year according to § 475(1) German Civil Code (BGB).
6.2 Guarantees and Customer Service
Information on any additional guarantees and their precise terms can be found for each product and on special information pages in the online shop. Please note that the description of condition and any special features of used collectibles is decisive.
7. Governing Law
All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law shall only apply to the extent that the protection granted to the consumer by mandatory provisions of the law of the country in which the consumer has their habitual residence is not deprived.
The place of jurisdiction for all disputes arising from or in connection with the contractual relationship shall, to the extent legally permissible, be the competent court in Germany.
8. Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
